Situation in Venezuela: ICC Pre-Trial Chamber I authorizes the resumption of the investigation

“Today, 27 June 2023, Pre-Trial Chamber I of the International Criminal Court (the ‘ICC’ or ‘Court’) issued its decision authorising the ICC Prosecution to resume its investigation in the situation in the Bolivarian Republic of Venezuela I (the ‘Situation’ and ‘Venezuela’, respectively).”

“In relation to the factors the Chamber considered to be determinative to its conclusion, it found that it appears that Venezuela is not investigating the factual allegations underlying the contextual elements of crimes against humanity, and that the focus of the domestic investigations appears to generally be on direct and/or lower level perpetrators.”
